18 U.S.C. § 2257 Compliance Statement

1. Introduction
18 U.S.C. § 2257 is a United States federal law that imposes record-keeping requirements on producers of "actual sexually explicit conduct" — meaning visual depictions involving real human beings. The implementing regulations are found at 28 C.F.R. Part 75.
This page sets out VNPocket's compliance position with respect to § 2257 and describes how we handle content on the Platform.
2. Nature of Content
2.1. Platform-Curated Content
VNPocket is a community platform dedicated to visual novels and related games. The game content displayed on VNPocket — including cover images, screenshots, CGs (computer graphics), and promotional art — consists of:
- Drawings and illustrations
- Cartoons and anime-style artwork
- Computer-generated imagery (CGI) and rendered graphics
- Other visual depictions that are entirely fictional in nature
No actual human beings were used in the creation of these visual depictions.
2.2. Third-Party Game Information
VNPocket aggregates game metadata (titles, descriptions, cover art, screenshots, developer names) from publicly available third-party sources for informational and community purposes. These materials are produced by third-party game developers and publishers. To our knowledge, such content consists exclusively of illustrated, animated, or computer-generated artwork — not depictions of real persons.
3. Exemption Statement
The visual content available on VNPocket does not depict "actual sexually explicit conduct" as defined by 18 U.S.C. § 2256, because it does not involve real human beings.
Therefore, the record-keeping requirements of 18 U.S.C. § 2257 and its implementing regulations (28 C.F.R. Part 75) do not apply to the owners, operators, or content of this website.
This exemption applies to all platform-curated content and all third-party game content displayed on VNPocket.
4. User-Generated Content & Moderation
VNPocket allows users to upload certain types of content, including game save files, forum posts, comments, reviews, and profile information (avatars, bios). To maintain our § 2257 exemption and protect our community:
4.1. Prohibited Uploads
Users are strictly prohibited from uploading, posting, or sharing:
- Photographs, videos, or any visual depictions of real human beings engaged in sexually explicit conduct.
- AI-generated imagery that is designed to realistically depict identifiable real persons in sexually explicit contexts.
- Any content that would trigger § 2257 record-keeping requirements.
4.2. Content Moderation
We actively moderate user-generated content to enforce these restrictions. Our moderation practices include:
- Staff review of reported content.
- Removal of violating content upon discovery or report.
- Account suspension or termination for users who violate these policies (see our Terms of Service, Sections 4 and 13).
4.3. Reporting Violations

5. Zero Tolerance Policy — Child Sexual Abuse Material (CSAM)
This policy applies to all forms of content, including but not limited to:
- Photographs and videos depicting real minors in sexual situations.
- Any other material that constitutes CSAM under applicable law.
5.1. Actions We Take
- Immediate removal of any identified CSAM content.
- Permanent termination of the offending user's account with no possibility of reinstatement.
- Reporting to authorities, including the National Center for Missing & Exploited Children (NCMEC) via their CyberTipline, and relevant law enforcement agencies in the applicable jurisdiction.
- Preservation of evidence as required by law to assist in investigations.
