DMCA Takedown Policy

1. Introduction & Scope
VNPocket ("we," "our," or the "Platform") respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. We will respond expeditiously to claims of copyright infringement reported to our Designated Copyright Agent.
This policy applies to all content accessible through the VNPocket service, including but not limited to:
- User-uploaded game save files
- Forum posts, comments, and reviews
- User profile content (avatars, bios)
- Any other user-generated content hosted on the Platform
Note on aggregated data: VNPocket also displays game information (titles, descriptions, cover art, screenshots) aggregated from publicly available third-party sources for informational and community purposes. If you believe such aggregated content infringes your copyright, please follow the same notice procedure below, and we will review your claim promptly.
2. Designated Copyright Agent
All DMCA notices and counter-notifications should be sent to our Designated Copyright Agent:

Please use the subject line format above to ensure your notice is routed and processed promptly.
3. Filing a DMCA Takedown Notice
If you are a copyright owner (or authorized to act on behalf of one) and believe that material hosted on VNPocket infringes your copyright, you may submit a written DMCA takedown notice containing the following information:
- Identification of the copyrighted work: A description of the copyrighted work you claim has been infringed. If multiple works are covered by a single notification, provide a representative list.
- Identification of the infringing material: The specific URL(s) or other information reasonably sufficient to permit us to locate the material on VNPocket.
- Your contact information: Your full legal name, mailing address, telephone number, and email address.
- Good faith statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy statement: A statement, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.
- Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Notices that do not substantially comply with these requirements may not receive a response. We may request additional information before processing incomplete notices.
4. How We Process Takedown Notices
Upon receiving a valid DMCA takedown notice, we will take the following steps:
- Review: We will review the notice for completeness and compliance with DMCA requirements.
- Removal or disabling: If the notice is valid, we will expeditiously remove or disable access to the allegedly infringing material, typically within 1–3 business days of receiving a complete notice.
- Notification to the uploader: We will make reasonable efforts to notify the user who posted the content that it has been removed pursuant to a DMCA notice. The notification will include a copy of the takedown notice (with the complainant's personal contact information redacted where appropriate) and information about how to file a counter-notification.
- Record keeping: We maintain records of all DMCA notices and counter-notifications received for compliance and repeat infringer tracking purposes.
5. Counter-Notification Procedure
If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification. To be effective, your counter-notification must be a written communication sent to our Designated Copyright Agent (see Section 2) containing the following:
- Identification of the removed material: Identification of the material that was removed or disabled and the location (URL) where it appeared before removal.
- Good faith statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your contact information: Your full legal name, mailing address, telephone number, and email address.
- Consent to jurisdiction: A statement that you consent to the jurisdiction of a competent court in your district (or, if outside the United States, any judicial district in which VNPocket may be found), and that you will accept service of process from the person who submitted the original DMCA notice or their agent.
- Signature: Your physical or electronic signature.
5.1. What Happens After a Counter-Notification
Upon receiving a valid counter-notification, we will:
- Forward a copy of the counter-notification to the original complainant.
- Inform the original complainant that the removed material may be restored after 10 business days.
- Restore the removed material within 10 to 14 business days after receiving the counter-notification, unless we receive notice from the original complainant that they have filed a court action seeking a restraining order against the content provider.
6. Repeat Infringer Policy
In accordance with 17 U.S.C. § 512(i), VNPocket has adopted and reasonably implements a policy for the termination of accounts of users who are repeat infringers, under appropriate circumstances.
- First offense: The infringing content is removed and the user is notified via email. A strike is recorded against the account.
- Second offense: The infringing content is removed, the user receives a formal written warning, and a second strike is recorded. The account may be temporarily suspended.
- Third offense: The user's account will be permanently terminated. All content associated with the account may be removed.
We reserve the right to terminate any account at any time if we determine, in our sole discretion, that the user is a repeat infringer, regardless of the number of strikes. Strikes may be removed if a counter-notification is successful or if the original complaint is withdrawn.
7. Misrepresentation Warning
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing — or that material was removed or disabled by mistake or misidentification — may be liable for damages, including costs and attorneys' fees incurred by the alleged infringer, the copyright owner, or the service provider.
Before filing a DMCA takedown notice, please carefully consider whether the use of the copyrighted material may constitute fair use. If you are unsure whether the content you are reporting is infringing, we strongly recommend consulting a qualified attorney before submitting a notice.
8. Non-U.S. Copyright Claims
The DMCA is a United States law. If you are a copyright holder located outside the United States and believe that content on VNPocket infringes your rights under your local copyright laws, you may still contact us using the same procedure described in Section 3.
While we are not legally obligated to follow non-U.S. copyright frameworks, we take all legitimate copyright claims seriously and will review them on a case-by-case basis. Please provide:
- Identification of the copyrighted work and the allegedly infringing material (with URLs).
- Evidence of your ownership or authorization to act on the owner's behalf.
- The legal basis for your claim (applicable law or treaty).
- Your contact information.
We aim to respond to all international copyright claims within the same timeframe as DMCA notices.
9. Content Types & Special Considerations
9.1. User-Uploaded Content
User-generated content (save files, forum posts, reviews, comments) is uploaded directly by our users. Standard DMCA takedown and counter-notification procedures apply in full to this content.
9.2. Aggregated Game Information
VNPocket displays game metadata (titles, descriptions, cover images, screenshots, developer names) sourced from publicly available third-party platforms. This information is presented for informational and community discussion purposes. If you are a rights holder and believe that the display of such information infringes your rights, please contact us and we will review your claim. In many cases, we can update, correct, or remove the specific content in question without a formal DMCA process.
9.3. External Links
VNPocket may contain links to external websites posted by users or curated by staff. We are not responsible for the content hosted on external sites. If infringing material exists on a third-party website, please contact that website's operator directly.
