1. Introduction

Welcome to VNPocket ("we," "our," "us," or the "Platform"). VNPocket is an online community platform dedicated to visual novels and related games. By accessing or using our website, services, forums, membership features, and community tools (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). 2. Age Restriction (18+)

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to access VNPocket. By accessing the Service, you represent and warrant that:

• You are of legal age to view adult-oriented content in your jurisdiction.
• Accessing adult content is legal in your jurisdiction.
• You accept full responsibility for determining whether the content available through our Service is legal in your location.

Any access by minors is strictly prohibited. We reserve the right to restrict or block access from jurisdictions where the content available on our platform may not be legally permissible.

3. User Accounts

To access certain features (such as downloading games, posting in forums, purchasing memberships, or uploading save files), you may be required to create an account.

• One Account Per Person: Each individual may maintain only one account. Creating multiple accounts to circumvent bans, restrictions, or membership limits is prohibited.
• No Account Sharing: Your account is personal and non-transferable. You may not share your login credentials with others or allow others to access the Service through your account.
• Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately if you suspect unauthorized access.
• Accuracy: You agree to provide accurate and current information during registration and to update such information as necessary.
• Banned Account Re-registration: If your account has been suspended or terminated, you may not create a new account without our prior written consent.
• Account Deletion: You may request deletion of your account at any time through your account settings. Upon deletion, your personal data will be handled in accordance with our Privacy Policy. Certain information may be retained as required by law or for legitimate business purposes.

4. Community Guidelines & User Generated Content

VNPocket allows users to upload content, including but not limited to game save files, forum posts, reviews, comments, and profile information (collectively, "User Content").

4.1. Ownership & License

You retain all ownership rights in your User Content. By submitting User Content to VNPocket, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, display, and distribute your User Content solely in connection with operating and improving the Service. This license terminates when you delete your User Content or your account, except where your content has been shared with others and they have not deleted it.

4.2. Content Moderation

We have the right, but not the obligation, to monitor, review, edit, or remove any User Content at our sole discretion. We do not endorse any User Content and expressly disclaim any liability in connection with User Content.

4.3. Prohibited Content

You agree NOT to upload, post, or share content that:

• Is illegal in your jurisdiction or under generally applicable international laws (e.g., CSAM, non-consensual sexual content). We have a specific Zero Tolerance Policy for Child Sexual Abuse Material (CSAM).
• Contains real-life violence, gore, or threats.
• Infringes on the intellectual property rights of others (pirated commercial games, unauthorized assets).
• Contains malware, viruses, or malicious code (especially relevant for save files).
• Constitutes spam, harassment, hate speech, or targeted abuse.
• Contains personal or private information of any third party without their consent.

4.4. Forums and Social Interaction

• Treat other users with respect and engage in good faith.
• Do not engage in doxxing or revealing private information about others.
• Administrative staff reserve the right to edit, move, or delete any thread or post that disrupts the community.

5. Copyright & DMCA

VNPocket respects intellectual property rights and complies with the Digital Millennium Copyright Act ("DMCA"). If you believe your copyrighted work has been copied or made available on the Service in a way that constitutes infringement, you may submit a DMCA takedown notice.

5.2. Notice & Counter-Notice

5.3. Repeat Infringers

In accordance with the DMCA and other applicable law, we have adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Service or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

6. Membership, Subscriptions & Billing

6.1. Paid Memberships

VNPocket may offer paid membership plans ("Membership") that provide access to premium features. By subscribing to a Membership, you agree to the pricing and payment terms presented at the time of purchase.

6.2. Automatic Renewal

Memberships automatically renew at the end of each billing cycle (monthly or annually, as selected) unless you cancel before the renewal date. You will be charged the then-current rate for your plan at each renewal.

6.3. Cancellation

You may cancel your Membership at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the end of your paid period.

6.4. Refund Policy

Due to the digital nature of the services provided, all Membership payments are final and non-refundable, except where required by applicable law. We do not provide refunds or credits for partial billing periods, downgrades, or unused time.

6.5. Price Changes

We reserve the right to adjust pricing for our Memberships. Any price changes will take effect at the start of the next billing cycle following notice to you. Your continued use of the Membership after the price change constitutes your agreement to pay the revised amount.

6.6. Virtual Currency & Credits

If VNPocket offers virtual currency, credits, or tokens, these are non-refundable, have no cash value, and may not be transferred or exchanged outside the Service. We reserve the right to modify or discontinue virtual currency programs at any time.

7. Intellectual Property

7.1. Platform IP

The Service, including its design, logos, graphics, code, and documentation (excluding User Content and third-party game data), is the property of VNPocket and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.

7.2. Third-Party Game Content

Game titles, artwork, descriptions, and related assets displayed on VNPocket belong to their respective developers and publishers. VNPocket aggregates publicly available information for informational and community purposes. All trademarks, service marks, and trade names are the property of their respective owners.

8. Third-Party Content & Data

VNPocket aggregates game information, metadata, and links from various third-party sources. We make reasonable efforts to ensure accuracy but:

• We do not guarantee the accuracy, completeness, or timeliness of any third-party data displayed on the platform.
• Game availability, pricing, and descriptions are sourced from external platforms and may change without notice.
• External links posted by users or curated by the platform are provided for convenience. We are not responsible for the content, privacy practices, or availability of third-party websites.
• We are not affiliated with, endorsed by, or sponsored by any game developer or publisher unless explicitly stated.

9. Prohibited Conduct

In addition to the content restrictions in Section 4, you agree not to:

• Use any automated means (bots, scrapers, crawlers) to access, collect, or index content from the Service without our prior written permission.
• Attempt to bypass, circumvent, or disable any security features, rate limits, or access controls of the Service.
• Interfere with or disrupt the Service or servers/networks connected to the Service, including through DDoS attacks or other malicious activity.
• Manipulate ratings, reviews, votes, or any community-driven metrics through fake accounts, coordinated campaigns, or automated tools.
• Reverse engineer, decompile, or disassemble any portion of the Service.
• Use the Service for any commercial purpose not expressly authorized by us.
• Impersonate any person or entity, or falsely claim an affiliation with any person or entity.
• Attempt to gain unauthorized access to other users' accounts or to the Service's administrative systems.

10. Disclaimers

THE SERVICE AND ALL CONTENT (INCLUDING USER-UPLOADED SAVE FILES, GAME DATA, AND THIRD-PARTY INFORMATION) ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VNPOCKET DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Without limiting the foregoing:

• Save Files: We do not guarantee that save files downloaded from the community will work with your specific game version or are free from errors. Use strictly at your own risk. We are not liable for any data loss or game corruption.
• Third-Party Data: Game information, pricing, availability, and descriptions are sourced from external platforms. We make no guarantees about their accuracy or currency.
• User Content: We do not endorse, verify, or guarantee the quality, safety, or legality of any User Content.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VNPOCKET, ITS OPERATORS, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the limitations above shall apply to the fullest extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless VNPocket, its operators, affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service or any activity under your account.
• Your User Content or any content you submit, post, or transmit through the Service.
• Your violation of these Terms.
• Your violation of any rights of any third party, including intellectual property rights.
• Your violation of any applicable law, rule, or regulation.

13. Account Suspension & Termination

13.1. By Us

We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Reasons for suspension or termination may include, but are not limited to:

• Violation of these Terms or any applicable law.
• Conduct that is harmful to other users, third parties, or the Service.
• Extended periods of inactivity.
• Requests from law enforcement or government agencies.

13.2. By You

You may terminate your account at any time by using the account deletion feature in your settings or by contacting us. Active Memberships should be cancelled before account deletion to avoid further charges.

13.3. Effect of Termination

Upon termination, your right to use the Service will immediately cease. The following provisions survive termination: Sections 4.1 (license to previously submitted User Content), 7 (Intellectual Property), 10 (Disclaimers), 11 (Limitation of Liability), 12 (Indemnification), 15 (Governing Law & Disputes), and 16 (General Provisions).

14. Modifications to Terms

We may revise these Terms at any time. When we make material changes, we will:

• Update the "Effective Date" at the top of this page.
• Make reasonable efforts to notify you via email (if you have an account) and/or by posting a prominent notice on the Service (such as a banner or notification).

Your continued use of the Service after the revised Terms take effect constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Service and, if applicable, cancel your Membership.

15. Governing Law & Disputes

15.1. Compliance with Local Law

You are responsible for complying with all laws and regulations applicable to your use of the Service in your jurisdiction. The Service may not be available or appropriate for use in all jurisdictions.

15.2. Dispute Resolution

In the event of any dispute arising out of or relating to these Terms or the Service, you agree to first attempt to resolve the dispute informally by contacting us at [email protected]. We will attempt to resolve the dispute through good-faith negotiation for a period of at least thirty (30) days.

15.3. Jurisdiction

VNPocket reserves the right to bring legal proceedings in any jurisdiction we deem appropriate. Nothing in these Terms shall limit our right to seek injunctive or other equitable relief in any court of competent jurisdiction.

16. General Provisions

16.1. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

16.2. Entire Agreement

These Terms, together with our Privacy Policy and DMCA Policy, constitute the entire agreement between you and VNPocket regarding the use of the Service and supersede all prior agreements, understandings, and communications.

16.3. Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of VNPocket.

16.4. Assignment

You may not assign or transfer these Terms, or any rights or obligations hereunder, without our prior written consent. We may freely assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets, or by operation of law.

16.5. Force Majeure

VNPocket shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, power failures, internet or telecommunications failures, or cyberattacks.

16.6. Governing Language

These Terms are written in English. In the event of any conflict between the English version and any translated version, the English version shall prevail.
